1. About these terms
1.1 These terms and conditions (the “Terms”) are an agreement between you and DocIt, a sole proprietorship owned by Sandeep Harikumar Nair, Mumbai, India (“DocIt”, “we”, “us”). They apply to the DocIt mobile app, the docit.one website and any related features or updates (together, the “Service”).
1.2 You accept the Terms when you tap “Agree and proceed” in the app, or when you use the Service. If you don’t agree, don’t use the Service.
1.3 Our privacy policy explains what data the Service handles and forms part of these Terms. These Terms are an electronic record under the Information Technology Act, 2000 and the rules made under it, and need no physical or digital signature.
2. Who can use DocIt
2.1 You must be at least 18 years old and able to enter a binding contract under the law that applies to you. DocIt is not meant for children and we don’t knowingly allow anyone under 18 to use it.
2.2 You may store documents of family members or others you look after (for example, your children’s certificates) if you have the right to hold them. See section 6.
3. What DocIt is, and what it is not
3.1 DocIt is a personal tool for scanning, reading, organising and storing copies of your documents on your own phone.
3.2 DocIt is not:
- a government, official or legal document service, and it is not affiliated with or approved by any government body or document issuer;
- a source of certified, attested or official copies. Copies stored in DocIt may not be accepted where an original or an official digital copy is required (for example, an official government digital locker);
- legal, tax, insurance, medical or financial advice. Where DocIt summarises an insurance policy or other document, it shows what the document appears to say. Your policy wording, the issuer and a qualified adviser are the authority.
4. How the Service works
4.1 Local storage. Documents and details you save are encrypted and stored on your phone. We don’t operate a server that receives, stores or processes your documents.
4.2 On-device reading. Text recognition and auto-filled details are produced on your phone using Google ML Kit. ML Kit sends Google technical diagnostic data (not your documents or their text), as described in the privacy policy.
4.3 Optional Google features. If you choose, you can sign in with Google, back up encrypted copies of your documents and the backup key to your own Google Drive, and add reminders to your own Google Calendar. These features run in your Google account, which you control.
4.4 New features. We may add features, including a cloud-based assistant. Any feature that sends your documents or their contents off your phone will be optional, will say clearly what it sends and where, and will only run after you agree to it.
4.5 Changes to the Service. We may change, suspend or stop any part of the Service at any time, for example to fix problems, improve security or meet legal requirements.
4.6 Availability. DocIt may not be available in every country, and some features may differ by country or language. We may set reasonable limits, for example on supported file types, file sizes or devices.
5. Accuracy, reminders and your responsibilities
5.1 Automatic reading can be wrong. Details that DocIt reads or fills in (such as names, ID numbers, amounts and dates) are generated automatically and may be incomplete or incorrect. You must check them before relying on them.
5.2 Reminders are best effort. Reminders, expiry status and “what needs attention” prompts are aids only. They depend on the dates saved in the app and on your phone and Google account. Notification settings, battery savers, “do not disturb”, a changed date or time, uninstalling the app or a lost signal can delay or block them. You remain responsible for every renewal, deadline, claim and obligation, whether or not DocIt reminds you.
5.3 Details you enter or confirm. You are responsible for the accuracy of the details you type, edit or confirm in DocIt. We are not liable for any loss caused by incorrect, incomplete or outdated details.
5.4 Your phone and accounts. You are responsible for keeping your phone, its screen lock, DocIt’s app lock and your Google account secure, and for everything done through them, including by anyone you let use them. We are not liable for loss or access to your documents caused by someone using your phone or Google account, or by your phone or account being lost, stolen, hacked or infected with malicious software.
6. Acceptable use
6.1 You may only use DocIt for lawful, personal purposes. You must not:
- create, store, alter or share forged, counterfeit, tampered or fraudulent documents, or use DocIt to misrepresent your identity or anyone else’s;
- store documents or personal data you have no right to hold, or other people’s documents without their permission or a lawful reason;
- use DocIt in breach of any law, including laws on identity documents, data protection, privacy and intellectual property;
- copy, modify, reverse engineer, decompile or resell the app, except as the law expressly permits;
- use bots, scrapers or other automated means to access the Service, or extract its content or data in bulk;
- introduce viruses or other malicious code, or try to gain unauthorised access to the Service or any related system;
- interfere with the Service, its security or other people’s use of it.
6.2 You are solely responsible for the documents you store and for how you share them.
7. Your content
7.1 You own your documents and the details you save. We claim no rights to them.
7.2 Because your content stays on your phone and in your own Google account, we don’t review it and are not responsible for it.
8. Data loss and backups
8.1 Your documents are encrypted with a key held on your phone. If you lose or reset your phone, uninstall the app, clear its data, or lose access to your backup and its key, your documents may be permanently unrecoverable.
8.2 We cannot recover your documents in any of these cases, because we never hold them or their keys.
8.3 Backing up is your responsibility. The optional Google Drive backup depends on your Google account and Google’s services, and we don’t guarantee that any backup will be complete or restorable. Keep the originals of important documents.
9. Third-party services
9.1 Parts of the Service rely on third parties, including Google (Google Play, Google sign-in, Google Drive, Google Calendar and ML Kit). Their own terms and privacy policies apply when you use them, and we are not responsible for their services, availability or changes.
9.2 Links to official websites, phone numbers or other services are provided for convenience. We don’t control them and are not responsible for their content.
10. Price and paid features
10.1 DocIt is free to use today.
10.2 We may introduce optional paid features or plans. Before you pay for anything, we will show the price and what it includes. Payments are processed by Google Play under its terms, and refunds follow Google Play’s refund policy and applicable law. Features that are free when you start using them will not be withdrawn and then charged for without notice.
10.3 If we offer subscriptions:
- they renew automatically at the end of each billing period unless you cancel before the renewal date in your Google Play subscription settings;
- if you cancel, paid features stay available until the end of the period you have paid for, and there is no refund for the unused part except as Google Play’s refund policy or applicable law provides;
- a free trial becomes a paid subscription when it ends unless you cancel before then;
- we will tell you in advance about any price change, and you can cancel before it applies.
11. Intellectual property
11.1 The app, website, name, logo, design and software are owned by us or our licensors. Subject to these Terms, we give you a personal, non-exclusive, non-transferable, revocable licence to use the app on devices you own or control.
11.2 If you send us feedback or ideas, we may use them without any obligation to you.
12. No warranties
12.1 To the fullest extent permitted by law, the Service is provided “as is” and “as available”, without warranties of any kind, express or implied, including warranties of accuracy, fitness for a particular purpose, merchantability, non-infringement, uninterrupted availability or freedom from errors or harmful components.
12.2 We don’t warrant that details read automatically will be accurate, that reminders will be delivered, that backups can be restored, or that the Service will meet your needs.
13. Limitation of liability
13.1 To the fullest extent permitted by law, we (and our owner, employees, contractors and partners) are not liable for any indirect, incidental, special, consequential or punitive loss, or for any loss of data, documents, profits, revenue, opportunity, goodwill, or for missed deadlines, renewals, claims, penalties or fines, arising from or related to the Service, even if we were told such loss was possible.
13.2 To the fullest extent permitted by law, our total liability for all claims arising from or related to the Service or these Terms is limited to the greater of (a) the amount you paid us for the Service in the 12 months before the claim arose, and (b) ₹1,000 (one thousand Indian rupees).
13.3 Nothing in these Terms limits liability that cannot be limited by law, such as liability for fraud, or for death or personal injury caused by negligence.
14. Indemnity
To the extent permitted by law, you agree to indemnify and hold harmless DocIt, its owner, employees and contractors against claims, losses, liabilities, costs and expenses (including reasonable legal fees) brought by a third party and arising from your breach of these Terms, your misuse of the Service, the documents you store or share, or your breach of any law or of anyone else’s rights, including where this is done by someone using your phone or account with your permission or because of your failure to keep them secure. You agree to cooperate reasonably with us in defending any such claim.
15. Your rights as a consumer
Nothing in these Terms excludes or limits rights you have under consumer protection or data protection law that cannot be excluded by agreement, including under the Consumer Protection Act, 2019 and the Digital Personal Data Protection Act, 2023 in India. If you live in another country, this includes the mandatory consumer and privacy rights of that country, such as the consumer guarantees under the Australian Consumer Law and your statutory rights in the UK. Where local law gives you more protection, that law applies.
16. Suspension and termination
16.1 You can stop using DocIt at any time by uninstalling it. Uninstalling removes the data stored by the app on your phone; it does not delete backups or calendar entries in your Google account. See how to delete your data.
16.2 We may suspend or end your access to the Service, or any feature, if you seriously or repeatedly breach these Terms, if required by law, or if we stop offering the Service.
16.3 Sections 3, 5, 6.2, 7, 8 and 11 to 21 continue to apply after these Terms end.
17. The previous DocIt service
An earlier version of DocIt stored documents on our servers. Those servers have been shut down, and documents that were stored only there are no longer available through the Service. See what happened to the old DocIt. Questions about it can be sent to the contact below.
18. Changes to these Terms
18.1 We may update these Terms. The version number and effective date at the bottom of this page show the current version.
18.2 If we make a material change, we will tell you in the app before it takes effect and may ask you to accept the new Terms. If you don’t accept them, you must stop using the Service. Changes don’t apply to disputes that arose before the change.
19. Governing law and disputes
19.1 These Terms are governed by the laws of India. If you are a consumer living outside India, you also keep the protection of the mandatory laws of the country where you live, and nothing in these Terms takes that away.
19.2 Before starting any formal proceedings, please contact us so we can try to resolve the issue informally within 30 days.
19.3 Any dispute that is not resolved informally will be referred to and finally resolved by arbitration under the Arbitration and Conciliation Act, 1996, by a sole arbitrator appointed by mutual agreement. The seat and venue of arbitration will be Mumbai, India, the language will be English, and the proceedings will be confidential. The arbitrator will decide how the costs are shared. Subject to this, the courts at Mumbai have exclusive jurisdiction, and either party may ask those courts for urgent interim relief.
19.4 Nothing in this section prevents you from approaching a consumer commission or other forum that you are entitled to use under the Consumer Protection Act, 2019, or from making a complaint to a data protection authority.
19.5 If you are a consumer living outside India, section 19.3 applies only if you agree to it at the time of the dispute. Otherwise you may bring a claim in the courts, or use a consumer body or small claims process, of the country where you live, where its law gives you that right.
20. Grievances and contact
20.1 In line with the Information Technology Act, 2000 and the rules made under it, and the Consumer Protection (E-Commerce) Rules, 2020 where applicable, you can raise any complaint or grievance about the Service with our Grievance Officer:
- Grievance Officer: Team DocIt
- Email: hello@docit.one
20.2 We will acknowledge a complaint within 24 hours and aim to resolve it within 15 days of receiving it.
21. General
21.1 Entire agreement. These Terms and the privacy policy are the entire agreement between you and us about the Service.
21.2 Severability. If any part of these Terms is found invalid or unenforceable, the rest stays in effect, and the invalid part will be applied as far as the law allows.
21.3 No waiver. If we don’t enforce a right, that doesn’t mean we give it up.
21.4 Assignment. You may not transfer your rights under these Terms. We may transfer ours to a successor, for example in a merger or sale, and will tell you if we do.
21.5 Events outside our control. We are not responsible for failures caused by events beyond our reasonable control, such as outages of third-party services, network failures or natural events.
21.6 Language. If these Terms are translated, the English version applies.
